A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 7-13-47 SO AS TO REQUIRE A PERSON WHO INTENDS TO OFFER AS A WRITE-IN CANDIDATE FOR ANY OFFICE ELECTED POPULARLY TO REGISTER WITH THE AGENCY RESPONSIBLE FOR CONDUCTING THE ELECTION TWO WEEKS BEFORE THE ELECTION OF HIS INTENTION TO SEEK THE OFFICE AS A WRITE-IN CANDIDATE, PAY ANY APPLICABLE FILING FEE, NOTIFY ANY OTHER CANDIDATES OF HIS INTENTION TO SEEK THE OFFICE AS A WRITE-IN CANDIDATE, AND PROVIDE AN EXCEPTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 7-13-47. (A) Two weeks before a special or general election, a person who intends to offer as a write-in candidate in that election must register with the agency responsible for the conduct of the election his intention to seek the office as a write-in candidate, pay any applicable filing fee, and notify any other candidates of his intention to seek the office as a write-in candidate.

(B) The provisions of this section do not apply when a candidate nominated by a political party dies, becomes disqualified after his nomination, or resigns his candidacy for a legitimate nonpolitical reason as defined in Section 7-11-50."

SECTION 2. This act takes effect upon approval by the Governor.
