TO AMEND SECTION 20-7-6805, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CREATION OF THE DEPARTMENT OF JUVENILE JUSTICE, SO AS TO CREATE THE DIVISION OF JUVENILE JUSTICE WITHIN THE DEPARTMENT OF CORRECTIONS, TO TRANSFER ALL FUNCTIONS, POWERS, DUTIES, RESPONSIBILITIES, AUTHORITY, ASSETS, LIABILITIES, RECORDS, PROPERTY, PERSONNEL, AND FUNDS OF THE DEPARTMENT OF JUVENILE JUSTICE TO THE DEPARTMENT OF CORRECTIONS; AND TO REQUIRE THE DEPARTMENT TO CONTRACT WITH COURT ADMINISTRATION FOR THE PROVISION OF INTAKE AND PROBATION SERVICES AND WITH OTHER STATE AGENCIES TO PROVIDE OTHER COMMUNITY SERVICES; AND TO REPEAL SECTIONS 20-7-6810 AND 20-7-6815 RELATING TO THE APPOINTMENT AND REMOVAL OF THE DIRECTOR OF THE DEPARTMENT OF JUVENILE JUSTICE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 20-7-6805 of the 1976 Code, as added by Act 383 of 1996, is amended to read:
"Section 20-7-6805. (A) There is created the South Carolina Department within the Department of Corrections, the Division of Juvenile Justice. Wherever the term 'department' appears in this article, it means the 'Division of Juvenile Justice in the Department of Corrections'.
(B) The functions, powers, duties, responsibilities, and authority exercised by the Department of Juvenile Justice as of September 30, 1998 are transferred to and devolved upon the Department of Corrections, together with all assets, liabilities, records, property, personnel, unexpended appropriations, and other funds of the Department of Juvenile Justice. All regulations, orders, or other actions of the Department of Juvenile Justice are considered to be the regulations and orders of the Department of Corrections and remain in such effect until specifically changed, repealed, or voided by the Department of Corrections.
(C) In carrying out its duties and responsibilities under this article, the department shall strive to provide services at the local level and shall contract with court administration for all intake and probation services, pursuant to subarticle (9), to be provided through the family court system and shall contract with other state agencies including, but not limited to, the Department of Mental Health and the Department of Social Services to provide community services in accordance with Section 20-7-6840."
SECTION 2. Sections 20-7-6810 and 20-7-6815 of the 1976 Code are repealed.
SECTION 3. This act takes effect October 1, 1998.
