A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING AN APPROPRIATELY LETTERED ITEM AT THE END OF SECTION 48-39-10 SO AS TO PROVIDE FOR A DEFINITION OF NAVIGABLE WATER FOR THE PURPOSES OF DOCK PERMITS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 48-39-10 of the 1976 Code, as amended, is further amended by adding an appropriately lettered item at the end to read:

"( ) 'Navigable water' means for the purposes of dock permitting any clear path of water located in a 'critical area' which has water in its title basin or creek fifty percent of the time and no obstructions, except that a bridge may be built across the navigable water blocking ingress and egress."

SECTION 2. This act takes effect upon approval of the Governor.
