TO AMEND SECTION 12-28-2740, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DISTRIBUTION OF "C" FUNDS DERIVED FROM THE TWO AND SIXTY-SIX ONE-HUNDREDTHS CENTS A GALLON GASOLINE TAX, SO AS TO PROVIDE FOR THE APPOINTMENT OF THE COUNTY TRANSPORTATION COMMITTEE, THE TERMS OF ITS MEMBERS, ATTENDANCE REQUIREMENTS FOR MEMBERS, AND THE POWERS OF THE COMMITTEE REGARDING EXPENDITURE OF MONIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 12-28-2740(B) of the 1976 Code, as added by Act 136 of 1995, is amended to read:
"(B) The funds expended must be approved by and used in furtherance of a countywide transportation plan adopted by a county transportation committee. The county transportation committee must be appointed by the county legislative delegation and must be made up of fair representation from municipalities and unincorporated areas of the county. County transportation committees may join in approving a regional transportation plan, and the funds must be used in furtherance of the regional transportation plan. This subsection does not prohibit the county legislative delegation from making project recommendations to the county transportation committee. A county transportation committee may expend from the funds allocated under this section an amount not to exceed one thousand dollars for reasonable administrative expenses directly related to the activities of the committee. Administrative expenses may include costs associated with copying, mailings, public notices, correspondence, and recordkeeping but do not include the payment of per diem or salaries for members of the committee. The funds expended must be approved by and used in futherance of a countywide transportation plan adopted by a county transportation committee.
(1) The committee must be appointed by the county legislative delegation and must be equal to the number of members of the county council. When county council members are elected from specific districts, there must be one member of the committee appointed from each district.
(2) A member's term of office begins at noon on July 1 of the year in which he is appointed for a period of four years and end at noon on July 1, except as otherwise provided in this section. The terms of office of existing committee members terminate July 1, 2001. No person may be appointed for more than two consecutive terms. At the discretion of the county legislative delegation, a number of these members equal to one more than half of their number may be reappointed for one more term, but these members are ineligible for reappointment.
(3) If a committee member resigns or fails to attend at least two-thirds of the regular committee meetings in any fiscal year beginning July 1, the county legislative delegation may appoint a replacement to complete that member's term of office. This replacement is eligible for appointment to one more term of four years.
(4) County transportation committees may join in approving a regional transportation plan, and the funds must be used in furtherance of the regional transportation plan. A county transportation committee may expend from the funds allocated under this section an amount not to exceed one thousand five hundred dollars for reasonable administrative expenses directly related to the activities of the committee. Administrative expenses may include costs associated with copying, mailings, public notices, correspondence, and recordkeeping, but do not include the payment of per diem or salaries for members of the committee."
SECTION 2. This act takes effect upon approval by the Governor.
