AN ACT TO ESTABLISH A SPARTANBURG COUNTY EDUCATION OVERSIGHT COMMITTEE AND TO DEVOLVE THE DUTIES AND FUNCTIONS OF THE SPARTANBURG COUNTY BOARD OF EDUCATION INCLUDING THE DISTRIBUTION OF MINIMUM FOUNDATION MONIES UPON THE OVERSIGHT COMMITTEE, TO PROVIDE THE PROCEDURES UNDER WHICH THESE MINIMUM FOUNDATION MONIES MUST BE DISTRIBUTED, AND TO ABOLISH THE SPARTANBURG COUNTY BOARD OF EDUCATION.

Be it enacted by the General Assembly of the State of South Carolina:

Education Oversight Committee established

SECTION 1. There is established an oversight committee, known as the Spartanburg County Education Oversight Committee, to be comprised of the chairperson of the board of trustees of each of the seven school districts in Spartanburg County to serve ex officio. The superintendents of the seven school districts of the county also shall serve on the oversight committee as ex officio members; provided, that the superintendents shall have no voting authority as members of the committee.

Chairman

SECTION 2. A chairman of the oversight committee shall be elected by the members of the committee. The chairman shall serve on a one-year rotational basis in accordance with procedures determined by the oversight committee.

Devolvement of powers; county board of education abolished

SECTION 3. The powers and duties of the Spartanburg County Board of Education including the distribution of minimum foundation monies are devolved upon the Spartanburg County Education Oversight Committee, and the Spartanburg County Board of Education is abolished.

Distribution of foundation monies

SECTION 4. The Spartanburg County Education Oversight Committee shall ensure that the minimum foundation monies are distributed on a fair and equitable basis. For this purpose, funding derived from the minimum foundation monies must be distributed annually to each of the seven school districts by the Spartanburg County Treasurer's Office in accordance with the formula guidelines as directed by the oversight committee.

Fiscal autonomy not decreased

SECTION 5. Nothing contained herein shall be construed as decreasing the fiscal autonomy of the seven school districts in Spartanburg County.

Time effective

SECTION 6. This act takes effect upon approval by the Governor.
