A BILL

TO AMEND TITLE 60, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LIBRARIES, ARCHIVES, MUSEUMS, AND ARTS, BY ADDING CHAPTER 14, SO AS TO ESTABLISH THE CONFEDERATE RELIC ROOM AND MUSEUM WITHIN THE STATE BUDGET AND CONTROL BOARD.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Title 60 of the 1976 Code is amended by adding:

"CHAPTER 14

Confederate Relic Room and Museum

Section 60-14-10. (A) There is hereby established within the State Budget and Control Board the Confederate Relic Room and Museum. The Confederate Relic Room and Museum shall be located on the site of the War Memorial Building on the campus of the University of South Carolina.

(B) (1) All artifacts, relics, and historical records stored or displayed at the Confederate Relic Room and Museum are deemed the property of the South Carolina Division of the United Daughters of the Confederacy (UDC) unless specifically purchased with funds appropriated by the General Assembly or provided by the State.

(2) No artifacts, relics, or historical records stored or displayed at the Confederate Relic Room and Museum which are the property of the UDC shall be loaned, used, transported, or displayed without approval of the UDC.

(C) No artifacts, relics, or historical records stored or displayed at the Confederate Relic Room and Museum which are owned by the State shall be permanently removed or disposed of except by a concurrent resolution of the General Assembly.

(D) The General Assembly shall provide for the maintenance and support of the Confederate Relic Room and Museum in the annual general appropriation act and may provide such other support it deems appropriate.

Section 60-14-20. (A) There is hereby created the Confederate Relic Room Advisory Committee. The committee shall be composed of the following seven members:

(1) the President of the South Carolina Division of the United Daughters of the Confederacy (UDC);

(2) the South Carolina Division Commander of the Sons of the Confederate Veterans;

(3) the Director of the Confederate Relic Room and Museum; (4) one member appointed by the Governor on the recommendation of the UDC;

(5) one member appointed by the Governor from the state at large;

(6) one member appointed by the Speaker of the House of Representatives; and

(7) one member appointed by the President Pro Tempore of the Senate.

(B) (1) The appointing authorities identified in subsection (A) shall forward the appointments to the Secretary of State.

(2) The committee members identified in items (1), (2) and (3) of subsection (A) shall serve terms coterminous with their terms of office or employment. The remaining members shall serve terms of two years and until their successors are appointed and qualify.

(C) The committee shall elect a chairman and such other officers it deems appropriate from among its members. The committee shall hold regular meetings, prescribe rules for its operations, use an identifying seal pertaining to the Confederate Relic Room and Museum's business, and make an annual report to the State Budget and Control Board and the General Assembly. For the purpose of transacting business, four members shall constitute a quorum. The members of the committee shall serve without compensation.

(D) The committee shall primarily aid the Confederate Relic Room and Museum in developing financial goals for conservation, preservation, and acquisitions, and shall assist in the implementation of such efforts to enhance the resources of the Confederate Relic Room and Museum. The committee may also make recommendations to the director of the Confederate Relic Room and Museum for acquisitions, exhibits, potential restorations, techniques and future goals of the Confederate Relic Room and Museum.

Section 60-14-30. To carry out the functions of the Confederate Relic Room and Museum, the State Budget and Control Board shall appoint a director. The UDC shall recommend a person for appointment. The director shall serve at the pleasure of the Board.

Section 60-14-40. The Confederate Relic Room and Museum may accept lands, buildings, money, relics, weapons, or any other thing of value on behalf of, or as additions to, the museum, either in the form of loans or grants or donations or bequests; may acquire land and items by purchase, lease, or otherwise; and may enter into contracts with any person to accomplish such purposes. Any such gifts, donations or bequests shall be deemed to be gifts to a charitable or eleemosynary organization. Donated funds may be expended to acquire, restore, preserve, and display the museum collection.

Section 60-14-50. (A) The Confederate Relic Room and Museum shall be a military and historical museum charged with the responsibility for the collection, preservation, and exhibition of archives, books, records, documents, maps, charts, military equipment, uniforms, flags, and any other such articles which relate to the period of the War Between the States and any period prior to or subsequent to the War. The Confederate Relic Room and Museum shall be open to the public at such times as may be determined by the director.

(B) The Confederate Relic Room and Museum is authorized to collect, retain, and expend fees from research and photographic processing requests and from the sale of promotional items."

SECTION 2. This act takes effect upon approval by the Governor.
