A BILL

TO AMEND SECTION 9-1-1140, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ESTABLISHMENT OF SERVICE CREDIT IN THE SOUTH CAROLINA RETIREMENT SYSTEM, SO AS TO ALLOW "BERRY PLAN" SERVICE BY PHYSICIANS IN THE UNITED STATES PUBLIC HEALTH SERVICE TO BE ESTABLISHED AS MILITARY SERVICE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The antepenultimate unnumbered paragraph of Section 9-1-1140 of the 1976 Code, as last amended by Act 87 of 1991, is further amended to read:

"Merchant marine seamen who served in active ocean-going service from December 7, 1941, to August 15, 1947, and civil service crew members aboard United States Army Transport Service and Naval Transportation Service vessels in ocean-going service in foreign waters during the same period may establish their period of service as creditable service in the manner that military service is established as creditable service pursuant to this section. Physicians who served in the United States Public Health Service pursuant to the 'Berry Plan' may establish their period of service as creditable service in the manner that military service is established as creditable service pursuant to this section."

SECTION 2. This act takes effect upon approval by the Governor.
