A CONCURRENT RESOLUTION

TO URGE THE MEDICAL UNIVERSITY OF SOUTH CAROLINA TO DETERMINE WHETHER CONTRACTS CONTEMPLATED BY THE UNIVERSITY AND COLUMBIA HCA AMOUNT TO A JOINT VENTURE, TO AUTHENTICATE THE FAIR MARKET VALUE OF ASSETS AND REEVALUATE THE MORGAN STANLEY EVALUATION, TO NOTIFY THE GENERAL ASSEMBLY AS TO ALL COSTS ASSOCIATED WITH THE PROJECT, AND TO REEXAMINE WHETHER COLUMBIA HCA IS THE APPROPRIATE PARTNER FOR THE MEDICAL UNIVERSITY OF SOUTH CAROLINA.

Whereas, the General Assembly wants to assure that health care is the best possible for all South Carolinians and does not want to jeopardize quality health care due to the consummation of an agreement between the Medical University of South Carolina and Columbia HCA and the resulting changes in health care delivery including, but not limited to, Columbia HCA's methods of cost containment; and

Whereas, the General Assembly wants to ascertain whether or not the citizens of South Carolina would be better served by the Medical University of South Carolina entering into an agreement for the operation of its facilities and services with an entity other than Columbia HCA, especially in light of the impending expiration of the letter of intent between the entities and the deviations from the procurement process that have occurred. Now, therefore,

Be it resolved by the House of Representatives, the Senate concurring:

That the General Assembly of the State of South Carolina, by this resolution, urges the Medical University of South Carolina Board of Trustees, President, and administration to:

(1) determine and report to the General Assembly as to whether or not the contracts contemplated by the Medical University of South Carolina and Columbia HCA amount to a joint venture;

(2) authenticate the fair market value of assets and reevaluate the Morgan Stanley evaluation;

(3) notify the General Assembly of all costs involved with the project; and

(4) reexamine whether Columbia HCA is the appropriate partner for the Medical University of South Carolina to carry its mission into the twenty-first century.

Be it further resolved that copies of this resolution be forwarded to the Medical University of South Carolina Board of Trustees and President.
