A BILL

TO AMEND SECTION 58-17-4096, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO TRESPASSING UPON RAILROAD TRACKS, SO AS TO EXEMPT A REGISTERED LAND SURVEYOR, HIS EMPLOYEE, OR HIS AGENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 58-17-4096 of the 1976 Code, as added by Act 458 of 1996, is amended by adding:

"(C) This section does not apply to a South Carolina registered land surveyor, his employee or agent, who enters upon a railroad right-of-way to find, occupy, set, or reference a survey point or monument."

SECTION 2. This act takes effect upon approval by the Governor.
