A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 15-3-160 SO AS TO PROVIDE THAT CIVIL ACTION MAY NOT BE BROUGHT AGAINST PSYCHOLOGISTS PERFORMING EVALUATION OR TREATMENT FUNCTIONS AS A RESULT OF A COURT APPOINTMENT AND TO PROVIDE EXCEPTIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 1, Chapter 3, Title 15 of the 1976 Code is amended by adding:

"Section 15-3-160. A civil action may not be brought in this State against a psychologist for any act or omission by the psychologist in the discharge of the responsibilities of the psychologist for performing evaluation or treatment functions as a result of a court appointment and the psychologist acts in good faith and the injury is not caused by gross negligence, recklessness, or intentional misconduct."

SECTION 2. This act takes effect upon approval by the Governor and applies to acts or omissions occurring on or after that date.
