A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 42-1-135 SO AS TO PROVIDE THAT A GROUP III CONSTABLE WORKING FOR A STATE AGENCY ON A NONPAID BASIS SHALL NEVERTHELESS BE CONSIDERED A STATUTORY EMPLOYEE FOR THE PURPOSE OF RECEIVING WORKER'S COMPENSATION BENEFITS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 42-1-135. A Group III Constable, as defined by the State Law Enforcement Division, working for a state agency on a nonpaid basis nevertheless shall be considered a statutory employee for the purpose of receiving worker's compensation benefits."

SECTION 2. This act takes effect upon approval by the Governor.
