A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 48-1-82 SO AS TO PROHIBIT THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL FROM PERMITTING THE QUALITY OF SURFACE WATERS TO BE CUMULATIVELY LOWERED MORE THAN 0.1 MG/1 FOR DISSOLVED OXYGEN FROM POINT SOURCES OR OTHER ACTIVITIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 48-1-82. Notwithstanding any other provision of law, if certain natural conditions cause or may cause a depression of dissolved oxygen in surface water, at no time and under no circumstances may the department establish, permit, or authorize the quality of the surface waters to be cumulatively lowered more than 0.1 mg/1 for dissolved oxygen from point sources or other activities:"

SECTION 2. This act takes effect upon approval by the Governor.
