A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 12-8-610 SO AS TO ALLOW A RESIDENT INDIVIDUAL TAXPAYER TO DIRECT HIS EMPLOYER TO CEASE STATE INCOME TAX WITHHOLDING ON THE TAXPAYER'S WAGES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 5, Chapter 8, Title 12 of the 1976 Code is amended by adding:

"Section 12-8-610. Notwithstanding any provision of this chapter, a resident individual taxpayer subject to withholding on wages pursuant to Section 12-8-520(A)(1) may direct his employer to cease withholding on the taxpayer's wages by means of a written notice to the employer. Upon receipt of the notice, the employer shall cease withholding on the employee's wages."

SECTION 2. This act takes effect on the first day of the third month following approval by the Governor.
