A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTIONS 9-1-1768 AND 9-11-305, SO AS TO PROVIDE AN INCREASE IN SERVICE RETIREMENT BENEFITS FOR MEMBERS OF THE SOUTH CAROLINA RETIREMENT SYSTEM AND SOUTH CAROLINA POLICE OFFICERS RETIREMENT SYSTEM WHO RETIRED BEFORE APRIL 1, 1991.

Whereas, members of the South Carolina Retirement System and South Carolina Police Officers Retirement System retiring after March 31, 1991, are allowed, as additional service credit, up to ninety days of unused accrued sick leave which translates into a benefit increase determined by the amount of accrued sick leave and number of years of service at retirement; and

Whereas, it is appropriate to extend a similar benefit increase to members of the South Carolina Retirement System and the South Carolina Police Officers Retirement System retiring before that date. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 13, Chapter 1, Title 9 of the 1976 Code is amended by adding:

"Section 9-1-1768. The service retirement allowance of members of the South Carolina Retirement System who retired before April 1, 1991, must be increased by a percentage that is the average percentage increase in the service allowance of members retiring in the fiscal year ending June 30, 1998, attributable to additional service credit allowed for accrued annual sick leave provided in Section 9-1-1140."

SECTION 2. Chapter 11, Title 9 of the 1976 Code is amended by adding:

"Section 9-11-305. The service retirement allowance of members of the South Carolina Police Officers Retirement System who retired before April 1, 1991, must be increased by a percentage that is the average percentage increase in the service allowance of members retiring in the fiscal year ending June 30, 1998, attributable to additional service credit allowed for accrued annual sick leave provided in Section 9-11-50(7)."

SECTION 3. This act takes effect July 1, 1999.
