A BILL

TO AMEND SECTION 15-78-60, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE EXCEPTIONS TO A WAIVER OF IMMUNITY IN THE TORT CLAIMS ACT, SO AS TO INCLUDE AS AN EXCEPTION A LOSS RESULTING FROM A YEAR 2000 COMPUTER OR AUTOMATION DEVICE UNLESS THE GOVERNMENTAL ENTITY NEGLIGENTLY CONSTRUCTED OR PROGRAMMED THE DEVICE ITSELF AND TO INCLUDE IMMUNITY FOR THE GOVERNMENTAL ENTITY IF THE COMPUTER HARDWARE OR SOFTWARE IS SUPPLIED BY A NONGOVERNMENTAL VENDOR.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 15-78-60 of the 1976 Code, as amended by Act 35 of 1997, is further amended by adding an appropriately numbered item to read:

"( ) a Year 2000 computer or automation device in use by a governmental entity unless the entity negligently constructed or programmed the device itself. However, the governmental entity is immune from liability for a Year 2000 error caused by computer hardware or software supplied by a nongovernmental vendor."

SECTION 2. This act takes effect upon approval by the Governor.
