TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 40-5-90 SO AS TO AUTHORIZE A PERSON TO REPRESENT A MEMBER OF HIS IMMEDIATE FAMILY IN MAGISTRATE'S COURT ON A CRIMINAL MATTER.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 5, Title 40 of the 1976 Code is amended by adding:
"Section 40-5-90. Notwithstanding other provisions of this chapter, a person may represent any member of his immediate family, as defined in Section 8-13-100(18), in magistrate's court on a criminal matter. The person must declare on oath, if required, that he has not accepted or will accept or take a fee or gratuity for the representation of the person or for any other matter relating to the representation of the person."
SECTION 2. This act takes effect upon approval by the Governor.
