TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-1085 SO AS TO ESTABLISH THE CRIMES OF DOMESTIC TERRORISM, AIDING AND ABETTING DOMESTIC TERRORISM, AND CONSPIRACY TO COMMIT DOMESTIC TERRORISM, AND TO PROVIDE THE DEATH PENALTY FOR VIOLATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 16-3-1085. (A) A person who, with or without forced entry, invades the home, residence, dwelling or property of another person with the intent to terrorize, harm, or rob its inhabitants or guests, and uses force, coercion, or duress to confine, contain, threaten, injure or rob the inhabitants, guests, or property is guilty of domestic terrorism and, upon conviction, must be sentenced to death.
(B) A person who aids or abets a person convicted pursuant to subsection (A), or who conspires with him or on his behalf, before or after the act of domestic terrorism, must be sentenced to death."
SECTION 2. This act takes effect upon approval by the Governor.
