TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-71-775 SO AS TO PROHIBIT THE IMPOSITION OF ANY PROBATIONARY OR WAITING PERIOD UPON AN EMPLOYEE FOR PURPOSES OF PARTICIPATING IN HIS NEW EMPLOYER'S POLICY OF GROUP ACCIDENT, HEALTH, OR ACCIDENT AND HEALTH INSURANCE SUBSEQUENT TO THAT EMPLOYEE'S HAVING LEFT EMPLOYMENT WITH A PRIOR EMPLOYER WHO LIKEWISE PROVIDED GROUP ACCIDENT, HEALTH, OR ACCIDENT AND HEALTH INSURANCE COVERAGE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 38-71-775. Notwithstanding any other provision of this chapter, when a person has been enrolled in a policy of group accident, health, or accident and health insurance by virtue of his employment with a particular employer and subsequently changes his employment and commences employment with another employer who likewise provides a policy of group accident, health, or accident and health insurance for its employees, the person shall not be subject to, nor be required to serve, any probationary or waiting period for the group coverage with the subsequent employer, and the person's coverage under the subsequent employer's group plan shall be effective fully and immediately upon his first day of employment with the subsequent employer."
SECTION 2. This act takes effect upon approval by the Governor.
