TO AMEND SECTION 12-21-2720, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LICENSE FEES AND TAXES FOR COIN-OPERATED MACHINES AND DEVICES, SO AS TO REQUIRE A PRORATED REFUND WHEN THE LICENSE FOR A VIDEO GAME WITH A FREE-PLAY FEATURE IS SURRENDERED TO THE DEPARTMENT OF REVENUE DURING THE LICENSE PERIOD AND TO DISALLOW THIS REFUND WHEN A LICENSE IS CANCELED, RELINQUISHED, OR REVOKED AS A RESULT OF AN ENFORCEMENT ACTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 12-21-2720 of the 1976 Code, as last amended by Act 155 of 1997, is further amended by adding an appropriately lettered subsection to read:
"( ) When a license required pursuant to subsection (A)(3) of this section is surrendered to the department during the license period, the department shall issue a prorated refund to the license holder. The proration must be made on a monthly basis beginning with the month after the month in which the license was surrendered. No license holder is eligible for this refund if the license has been canceled, relinquished, or revoked as a result of an enforcement action with regard to the license."
SECTION 2. This act takes effect June 1, 1999.
