A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-77-152 SO AS TO PROVIDE THAT FOR EVERY AUTOMOBILE INSURANCE POLICY OR CONTRACT ISSUED OR RENEWED IN THIS STATE AN ADDITIONAL SURCHARGE OF FIVE HUNDRED DOLLARS MUST BE CHARGED FOR VIOLATIONS OF, OR AS ADDITIONAL PENALTIES UNDER, CERTAIN PROVISIONS OF THE MOTOR VEHICLE LAWS IN TITLE 56, AND TO PROVIDE FOR THE USE OF THIS ADDITIONAL SURCHARGE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 38-77-152. Notwithstanding any other provision of law, for every automobile insurance policy or contract issued or renewed in this State a surcharge of five hundred dollars which is in addition to any other surcharge allowed by law, must be charged for each violation of, or as an additional penalty under, Sections 56-1-510, 56-1-515, 56-3-390, 56-5-750, 56-5-950, 56-5-1210, 56-5-1220, 56-5-1620, 56-5-2780, 56-5-2930, 56-5-2940, 56-5-2945, 56-5-2990, and 56-5-2995. This additional surcharge must be used, first, to pay down recoupment and, thereafter, to be paid to Uninsured Motorists Fund established under Section 38-77-151."

SECTION 2. This act takes effect upon approval by the Governor.
