A BILL

TO AMEND SECTION 44-96-320, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SOLID WASTE LANDFILLS, SO AS TO LIMIT NEW SOLID WASTE LANDFILLS TO A HEIGHT NO GREATER THAN SIXTY FEET ABOVE THE AVERAGE NATURAL TOPOGRAPHIC ELEVATION ON THE PROPERTY ON WHICH THE LANDFILL IS SITUATED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 44-96-320 of the 1976 Code, as added by Act 63 of 1991, is amended by adding at the end:

"(C) Notwithstanding any provision of this section or any other provision of law or regulation, no solid waste landfill may be permitted after June 30, 1999, which has a maximum height greater than sixty feet above the average natural topographic elevation on the property on which the landfill is situated."

SECTION 2. This act takes effect July 1, 1999.
