TO CREATE THE OPEN ENROLLMENT TASK FORCE TO STUDY AND REPORT ON ALL PHASES OF OPEN ENROLLMENT IN SOUTH CAROLINA PUBLIC SCHOOLS IN ORDER TO DETERMINE THE FEASIBILITY, EFFECTIVENESS, AND FAIRNESS OF OPEN ENROLLMENT.
Whereas, the General Assembly finds that open enrollment, the concept of permitting a student to apply for admission to the school of his choice, continues to surface as an issue in the search for quality education; and
Whereas, in order to make informed policy decisions concerning open enrollment and related issues, it is the intent of the General Assembly to create a task force to research and study open enrollment and to report their findings. Now, therefore,
Be it resolved by the House of Representatives, the Senate concurring:
That there is hereby created an Open Enrollment Task Force for the purpose of researching and studying open enrollment in the schools of South Carolina in order to enable the General Assembly to make informed policy decisions concerning open enrollment and the impact of open enrollment upon the schools of South Carolina.
The task force shall be composed of the following members:
(1) two members appointed by the Governor to represent the business community;
(2) two members of the House of Representatives appointed by the Speaker of the House;
(3) two members of the Senate appointed by the President Pro Tempore of the Senate;
(4) two nonlegislative members appointed by the chairman of the House Education and Public Works Committee;
(5) two nonlegislative members appointed by the chairman of the Senate Education Committee;
(6) the State Superintendent of Education or her designee;
(7) one member recommended by each of the following organizations and appointed by the Superintendent of Education:
(a) Education Oversight Committee;
(b) Palmetto Business Forum;
(c) Palmetto State Teachers Association;
(d) Protection and Advocacy for People with Disabilities;
(e) South Carolina Alliance of Black School Educators;
(f) South Carolina Association of Christian Schools;
(g) South Carolina Association of Independent Home Schools;
(h) South Carolina Association of Rural Educators;
(i) South Carolina Association of School Business Officials;
(j) South Carolina Association of School Superintendents;
(k) South Carolina Chamber Excellence in Education Council;
(l) South Carolina Congress of Parents and Teachers;
(m) South Carolina Education Association;
(n) South Carolina Independent School Association;
(o) South Carolina School Boards Association;
The first meeting of the task force shall be called by the member representing the South Carolina Chamber of Excellence in Education Council no later than September 1, 1999. At the first meeting, a chairman shall be elected by majority vote of the membership of the task force.
The task force shall issue a final report to the Governor and the General Assembly no later than January 1, 2001. This report shall include, but not be limited to, the following:
(1) a review of current research on open enrollment to include inter-district, intra-district, and by and between public and private schools;
(2) a survey of states which have enacted open enrollment policies;
(3) a report of states with open enrollment policies and their status in enacting accountability legislation;
(4) a review of policy issues to be addressed in open enrollment legislation including, but not limited to, the following questions:
(a) What are the desired outcomes in implementing open enrollment policies?
(b) What are the ramifications of mandatory plans versus voluntary plans?
(c) How will school board election laws affect parents whose children attend schools out of district?
(d) How do issues surrounding transportation effect the implementation of open enrollment options?
(e) Can existing school finance mechanisms support open enrollment policies?
(f) What measures are necessary to ensure all families have the opportunity to take advantage of open enrollment policies?
(g) What measures are necessary to ensure that admissions are open to all students?
(h) What impact has open enrollment policies had on student achievement?
(i) What is the impact of open enrollment policies on parent involvement in their child's education?
(j) How are students with special needs affected by open enrollment policies?
The task force shall report its findings and recommendations to the Senate Education Committee and the House Education Committee no later than January 1, 2001. Upon making its final report, the task force shall be dissolved.
Members of the task force shall be paid the usual mileage, subsistence, and per diem as authorized for members of state boards, commissions, and committees, to be paid from the approved accounts of the appointing authority.
