TO AMEND TITLE 41, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LABOR AND EMPLOYMENT, BY ADDING CHAPTER 47 SO AS TO ENACT PROVISIONS FOR FINANCIAL ASSISTANCE FOR COMPREHENSIVE JOB TRAINING AND RELATED SERVICES FOR ECONOMICALLY DISADVANTAGED, UNEMPLOYED, AND UNDEREMPLOYED INDIVIDUALS THROUGH OPPORTUNITIES INDUSTRIALIZATION CENTERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Title 41 of the 1976 Code is amended by adding:
Section 41-47-10. It is the purpose of this chapter to provide financial assistance for comprehensive job training and related services for economically disadvantaged, unemployed, and underemployed individuals through opportunities industrialization centers.
Section 41-47-20. As used in this chapter:
(1) 'Division' means the Division of Labor administered under the supervision and direction of the South Carolina Department of Labor, Licensing and Regulation pursuant to Section 41-3-10.
(2) 'Director' means the Director of the South Carolina Department of Labor, Licensing and Regulation in accordance with the provisions of Section 41-3-10.
(3) 'Economically disadvantaged' means an individual who meets the criteria for an economically disadvantaged person established by regulations promulgated by the division.
(4) 'Underemployed' means an individual:
(a) working part time but seeking full-time work; or
(b) working full time but receiving wages below the greater of:
( i) the poverty level determined in accordance with criteria established by the division; or
(ii) seventy percent of the lower living standard income level as determined by the United States Bureau of Labor Statistics.
(5) 'Unemployed' means an individual who is without a job and who wants, and is available for, work.
Section 41-47-30. (A) The director shall distribute, through the division, the money appropriated for:
(1) comprehensive job training and related services or job opportunities programs for economically disadvantaged, unemployed, and underemployed individuals, including persons of limited English-speaking ability, through opportunities industrialization centers; and
(2) the establishment and operation in South Carolina of these centers.
(B) Comprehensive job training and related services include: recruitment, counseling, remediation, motivational pre-job training, vocational training, job development, job placement, and other appropriate services enabling individuals to secure and retain employment at their maximum capacity.
Section 41-47-40. (A) The director, with the advice of the division, shall establish criteria for the distribution of state money for the purpose of Section 41-47-30. The criteria shall include requirements that:
(1) the program receiving state assistance:
(a) involve residents in the area to be served by the program in the planning and operation of the program; and
(b) involve the business community in the area to be served by the program in its development and operation;
(2) the distribution of assistance among areas within the State be equitable, with priority being given to areas with high unemployment or underemployment;
(3) financial assistance under this chapter to any program may not exceed twenty-five percent of the cost of the program, including costs of administration; and
(4) a program receiving financial assistance has adequate internal administrative controls, accounting procedures, personnel standards, evaluation procedures, availability of in-service training and technical assistance programs, and other policies necessary to promote the effective use of state money.
(B) The director may make a distribution in excess of the limit prescribed in subsection (A)(3) of this section if the director determines that the excess distribution is necessary to further the objectives of this chapter.
Section 41-47-50. The director, through the division, may make a distribution of money directly to a program or make a distribution subject to conditions that ensure use consistent with the distribution and utilization of money under federal legislation regarding job training and related services."
SECTION 2. This act takes effect upon approval by the Governor.
