A BILL

TO AMEND SECTION 16-7-140, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PENALTIES ASSOCIATED WITH THE UNLAWFUL WEARING OF A MASK UNDER CERTAIN CONDITIONS AND THE UNLAWFUL BURNING OF A CROSS, SO AS TO DELETE REFERENCES TO THE PENALTY FOR THE OFFENSE OF UNLAWFUL BURNING OF A CROSS DUE TO APPLICABLE COURT DECISIONS DECLARING SUCH ACTIVITY NOT UNLAWFUL, AND TO INCREASE THE MONETARY FINE ASSOCIATED WITH THE UNLAWFUL WEARING OF A MASK, AND TO RECLASSIFY THE CRIME FROM A MISDEMEANOR TO A FELONY OFFENSE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 16-7-140 of the 1976 Code is amended to read:

"Section 16-7-140. Any A person who violates any a provision of Sections Section 16-7-110 and 16-7-120 shall be is guilty of a misdemeanor felony and upon conviction shall must be punished by a fine of not more than five hundred thousand dollars or by imprisonment in the county jail for a period not to exceed twelve months more than five years."

SECTION 2. This act takes effect upon approval by the Governor.
