TO AMEND CHAPTER 11, TITLE 50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PROTECTION OF GAME, BY ADDING SECTION 50-11-75 SO AS TO PROVIDE THAT NO PERSON MAY BE CHARGED WITH SHOOTING DOVES OVER BAIT IF THE FIELD OVER WHICH THE DOVES ARE HUNTED HAS BEEN PREPARED BY RANDOMLY BROADCASTING WHEAT BY HAND OR MACHINE OVER THE FIELD, TO PROVIDE THAT IT IS UNLAWFUL FOR A PERSON TO HUNT OR TAKE DOVES BEFORE NOON, AND TO PROVIDE PENALTIES FOR VIOLATIONS OF THIS SECTION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 11, Title 50 of the 1976 Code is amended by adding:
"Section 50-11-75. (A) No person may be charged with shooting doves over bait if the field over which the doves are hunted has been prepared by randomly broadcasting wheat by hand or machine over the field where the wheat seeds have not been piled together in mounds, clumps, or similar nonrandom configurations.
(B) It is unlawful for a person to hunt or take doves before noon.
(C) A person who hunts or takes doves in violation of this section is guilty of a misdemeanor and, upon conviction, must be fined not less than one hundred dollars nor more that five hundred dollars or imprisoned for not more than thirty days."
SECTION 2. This act takes effect upon approval by the Governor.
