A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-3-1562 SO AS TO PROVIDE THAT A CORONER OR LAW ENFORCEMENT AGENCY MUST ATTEMPT TO NOTIFY AN ADULT CRIME VICTIM'S NEXT OF KIN BEFORE RELEASING THE VICTIM'S NAME TO THE PUBLIC, AND MUST NOTIFY THE NEXT OF KIN OF A MINOR CRIME VICTIM BEFORE THE VICTIM'S NAME MAY BE RELEASED TO THE PUBLIC.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 16-3-1562. (A) Notwithstanding another provision of law, to allow a coroner or a law enforcement agency an adequate opportunity to notify an adult crime victim's next of kin of the crime, neither a coroner nor a law enforcement agency may release the name of a crime victim to the public for a period of twelve hours after the crime victim is identified.

(B) Notwithstanding another provision of law, neither a coroner nor a law enforcement agency may release the name of a minor crime victim to the public before the victim's next of kin is notified of the crime."

SECTION 2. This act takes effect upon approval by the Governor.
