TO AMEND CHAPTER 30, TITLE 1, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE ADMINISTRATION OF STATE GOVERNMENT, BY ADDING SECTION 1-30-130, SO AS TO PROVIDE THAT ANY STATE DEPARTMENT OR AGENCY, WHICH REQUIRES A PERSON TO SUBMIT HIS SOCIAL SECURITY NUMBER ON A FORM FOR ANY USE BY THE DEPARTMENT OR AGENCY, MUST OFFER A PERSON WHO OBJECTS TO SUBMITTING HIS SOCIAL SECURITY NUMBER THE ALTERNATIVE OF SUBMITTING ANOTHER FORM OF IDENTIFICATION IN PLACE OF THE SOCIAL SECURITY NUMBER, AND TO PROVIDE THAT THE ABOVE PROVISIONS DO NOT APPLY TO THE REQUIRED COLLECTION OF SOCIAL SECURITY NUMBERS FOR THE PURPOSE OF ESTABLISHING, ENFORCING, AND COLLECTING CHILD SUPPORT OBLIGATIONS OR FOR THE PURPOSE OF PAYING STATE EMPLOYEE WAGES AND BENEFITS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 1-30-130. (A) Notwithstanding any other provision of law, all departments and agencies of state government which require a person to submit his social security number on an application form for purposes of registration, benefits, employment, or any other use of the department or agency, must offer to a person who objects to the request for his social security number the alternative of supplying another form of identification in place of the social security number.
(B)(1) The provisions of subsection (A) do not apply to the departments and agencies which are required to supply social security numbers for the purpose of establishing, enforcing, and collecting child support obligations.
(2) The provisions of subsection (A) do not apply to the use of social security numbers by the departments and agencies to pay state employee wages and benefits."
SECTION 2. This act takes effect July 1, 2000.
