TO AMEND SECTION 1-11-730, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO PERSONS ELIGIBLE TO PARTICIPATE IN THE STATE HEALTH AND DENTAL INSURANCE PLANS AFTER RETIREMENT OR TERMINATION FROM STATE SERVICE, SO AS TO PROVIDE FOR AN INCREMENTAL PORTION OF THE PREMIUM OF A PERSON RETIRING ON DISABILITY WITH AT LEAST FIVE BUT FEWER THAN TEN YEARS STATE SERVICE TO BE PAID BY THE STATE AT THE RATE OF TWENTY PERCENT A YEAR FOR EACH YEAR OF SERVICE IN EXCESS OF FIVE YEARS AND TO MAKE THIS AMENDMENT RETROACTIVE WITH RESPECT TO THE DATE OF DISABILITY RETIREMENT AND PROSPECTIVE WITH RESPECT TO PAYMENT OF PREMIUMS AND MEDICAL EXPENSES COVERED.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 1-11-730(D) of the 1976 Code, as last amended by Act 342 of 1994, is further amended to read:
"(D) A person covered by the plans who retires with at least five years' state-covered entity service credited under a state retirement system is eligible to participate in the plan by paying the full premium costs as determined by the board, if the last five years are consecutive and in a full-time permanent position with a state-covered entity. However, if a person eligible to participate in the plans pursuant to this subsection has been disabled while employed by the State and is taking a disability retirement under a retirement system provided in Title 9, the person is eligible for state-paid premiums at the rate of twenty percent of the state portion of the premium for each year of state-covered entity service in excess of the five years making the person eligible under this section, prorated for periods less than one year."
SECTION 2. This act takes effect upon approval by the Governor and has retroactive effect with respect to the time of disability retirement, but applies only to premiums becoming due and medical expenses incurred on and after the date of the Governor's signature.
