TO AMEND ACT 607 OF 1986, AS AMENDED, RELATING TO THE MARION COUNTY BOARD OF EDUCATION, SO AS TO AUTHORIZE THE BOARD TO ACQUIRE SCHOOL BUILDINGS AND OTHER FACILITIES RELATING TO SCHOOL DISTRICT OPERATIONS, TO ALLOW THIS ACQUISITION BY MEANS OF A FINANCING AGREEMENT, AND TO PROVIDE THAT FOR PURPOSES OF THE PROVISIONS OF LAW RESTRICTING THE USE OF FINANCING AGREEMENTS BY A GOVERNMENTAL ENTITY TO ACQUIRE REAL PROPERTY THAT THE MARION COUNTY BOARD OF EDUCATION IS NOT A "GOVERNMENTAL ENTITY" SUBJECT TO THE RESTRICTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 6 of Act 607 of 1986 is amended to read:
"Section 6. The county board of education has the authority to operate the school district or districts in any manner approved by the elected board, including the delegation of authority to any school district board of trustees. In connection with the operation of one or more of the school districts, the county board of education is authorized to acquire school buildings and other facilities related to the operation of the school district or school districts. The county board of education is further empowered to acquire these buildings and facilities by entering into a 'financing agreement' as that term is defined in Section 11-27-110(A) of the 1976 Code. However, the county board of education is not considered a 'governmental entity' as that term is defined in Section 11-27-110(A) of the 1976 Code. Consolidation of any existing school districts or abolition of any district board of trustees by the board of education must first have the approval of the qualified electors in the school district in a referendum called in the manner as provided for in Chapter 9, Title 4, of the 1976 Code."
SECTION 2. This act takes effect upon approval by the Governor.
