A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 12-39-12 SO AS TO AUTHORIZE A COUNTY TREASURER TO APPOINT AN EMPLOYEE AS DEPUTY TREASURER TO ACT ON BEHALF OF THE TREASURER UNDER CERTAIN CONDITIONS; AND TO AMEND SECTION 12-39-40, RELATING TO THE AUTHORITY OF A COUNTY AUDITOR TO APPOINT A CHIEF CLERK TO DISCHARGE THE DUTIES AND RESPONSIBILITIES OF THE AUDITOR UNDER CERTAIN CONDITIONS, SO AS TO AUTHORIZE AN AUDITOR TO APPOINT A DEPUTY AUDITOR UNDER CERTAIN CONDITIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The General Assembly finds that on some occasions it is necessary that someone possess authority to act on behalf of the county auditor or treasurer. The purpose of this act is to authorize a county auditor or treasurer to appoint someone in his office to be his deputy with authority to act on his behalf when incapacitated or when temporarily absent.

SECTION 2. The 1976 Code is amended by adding:

"Section 12-39-12. (A) A county treasurer may appoint an employee in his office to be his deputy. The appointment must be filed with the Comptroller General and the governing body of that county. When the appointment is filed, the deputy may act for and on behalf of the county treasurer when the treasurer is incapacitated by reason of a physical or mental disability or during a temporary absence.

(B) If there is a vacancy in the office of county treasurer by reason of death, resignation, or disqualification, the appointed deputy shall carry out the duties of the office until a successor is appointed or elected and qualified."

SECTION 3. Section 12-39-40 of the 1976 Code is amended to read:

"Section 12-39-40. (A) In the event of a vacancy by reason of death, resignation or disqualification in the office of county auditor in any county in this State having a chief clerk in the auditor's office, the duties and functions of such office shall be discharged by the chief clerk in the interval between the occurrence of such vacancy and the appointment and qualification of a successor. A county auditor may appoint an employee in his office to be his deputy. The appointment must be filed with the Comptroller General and the governing body of that county. When the appointment is filed, the deputy may act for and on behalf of the county auditor when the auditor is incapacitated by reason of a physical or mental disability or during a temporary absence.

(B) If there is a vacancy in the office of county auditor by reason of death, resignation, or disqualification, the appointed deputy shall carry out the duties of the office until a successor is appointed or elected and qualified."

SECTION 4. This act takes effect upon approval by the Governor.
