TO AMEND SECTION 12-6-3385, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REFUNDABLE HIGHER EDUCATION TUITION TAX CREDIT, SO AS TO DELETE THE REQUIREMENT FOR ELIGIBILITY FOR THE CREDIT THAT THE STUDENT HAVE GRADUATED FROM HIGH SCHOOL OR COMPLETED A HIGH SCHOOL HOME SCHOOLING PROGRAM WITHIN TWELVE MONTHS BEFORE ENROLLING IN THE INSTITUTION OF HIGHER EDUCATION AND TO AMEND ACT 418 OF 1998, RELATING TO LIFE SCHOLARSHIPS AND THE TUITION TAX CREDIT, SO AS TO REVISE THE EFFECTIVE DATE LIMITING TAX CREDIT ELIGIBILITY TO STUDENTS GRADUATING FROM HIGH SCHOOL DURING OR AFTER MAY, 1997.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 12-6-3385(B)(3)(c) of the 1976 Code, as added by Act 418 of 1998, is amended to read:
"(c) who, within twelve months before enrolling:
(i) graduated from a high school in this State;
(ii) successfully completed a high school home school program in this State in the manner required by law; or
(iii) graduated from a preparatory high school outside this State while a dependent of a parent or guardian who is a legal resident of this State and has custody of the dependent;"
SECTION 2. Section 3 of Act 418 of 1998 is amended to read:
"SECTION 3. This act takes effect upon approval by the Governor; provided, however, the provisions of Section 2 are effective for taxable years beginning after 1997 and apply only for persons graduating from high school during or after May, 1997."
SECTION 3. This act takes effect upon approval by the Governor.
