A BILL

TO AMEND SECTION 40-35-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO DEFINITIONS FOR THE REGULATION OF NURSING HOMES AND RESIDENTIAL CARE FACILITIES, SO AS TO AMEND THE DEFINITION "COMMUNITY RESIDENTIAL CARE FACILITY" BY EXCLUDING A FACILITY PROVIDING CARE FOR THREE OR FEWER PEOPLE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 40-35-20(3) of the 1976 Code is amended to read:

"(3) `Community residential care facility' means a facility defined for licensing purposes under law or pursuant to regulations for community residential care facilities by the Department of Health and Environmental Control, whether proprietary or nonprofit; provided that the definition shall not include a facility providing care for three or fewer people."

SECTION 2. This act takes effect upon approval by the Governor.
