A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-11-235, SO AS TO PROVIDE THAT THE STATE BUDGET AND CONTROL BOARD SHALL ESTABLISH A SENIOR EXECUTIVE SERVICE TO ATTRACT, DEVELOP, AND RETAIN HIGHLY COMPETENT SENIOR LEVEL MANAGERS FOR EXECUTIVE POSITIONS IN STATE GOVERNMENT, TO PROVIDE THE CRITERIA APPLICABLE TO MEMBERS, INCLUDING THE RIGHT TO RETURN TO A POSITION SUBJECT TO THE STATE EMPLOYEE GRIEVANCE PROCEDURE ACT, AND TO SPECIFY THOSE PERSONS WHO MAY APPLY FOR SELECTION TO THE SERVICE, TO ESTABLISH THE SENIOR EXECUTIVE SERVICE SCREENING PANEL AND PROVIDE FOR ITS POWERS AND DUTIES, INCLUDING THE SCREENING, SELECTION, REVIEW, AND REMOVAL OF APPLICANTS FOR AND MEMBERS OF THE SENIOR EXECUTIVE SERVICE, AND TO PROVIDE FOR THE OFFICE OF HUMAN RESOURCES OF THE STATE BUDGET AND CONTROL BOARD TO STAFF THIS PANEL.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 3, Chapter 11, Title 8 of the 1976 Code is amended by adding:

"Section 8-11-235. (A) As used in this section:

(1) 'board' means the State Budget and Control Board;

(2) 'covered position' means a position in state service where the holder is subject to Article 5, Chapter 17 of this title, the State Employee Grievance Procedure Act;

(3) 'Office of Human Resources' means the Office of Human Resources of the board;

(4) 'panel' means the Senior Executive Service Screening Panel established pursuant to subsection (D) of this section;

(5) 'service' means the Senior Executive Service established by this section.

(B) The State Budget and Control Board shall establish and maintain a Senior Executive Service to attract, develop, and retain highly competent senior level managers for the purpose of promoting the efficient administration of agencies through training and management development programs. The service shall serve as a system of personnel administration for executive positions that are predominantly policymaking or managerial in nature. The board shall develop guidelines to implement the service including, but not limited to, a designation of executive positions which are appropriate for service members, membership criteria, leadership and professional development, and rights on return to a covered position.

(C) Membership in the service must be based on applicants meeting specific criteria. Membership criteria must be established by board guidelines and may include a degree or certificate requirement, a service requirement of at least fifteen years of South Carolina state service which must include a managerial experience component, and occupation of a position designated by the board. A person who leaves a covered position to join the service and who subsequently returns to a covered position automatically on such return regains rights previously held under Article 5, Chapter 17 of this title, the State Employee Grievance Procedure Act.

(D) There is established the Senior Executive Service Screening Panel consisting of seven members as follows: a chairman and two other members appointed by the Governor; two members appointed by the chairman of the Senate Finance Committee; and two members appointed by the chairman of the Ways and Means Committee. Members shall serve for terms of three years and until their successors are appointed and qualify, except that of those first appointed by the respective committee chairmen, one shall serve for a term of one year and one shall serve for a term of two years, and the terms must be noted on the appointment. Members shall serve without compensation but are eligible to receive mileage, subsistence, and per diem as provided by law for members of state boards, committees, and commissions. The panel shall screen applicants for selection to the service, select applicants for membership in the service, establish continuing education requirements, systematically review existing service members, and remove members from the service. The Office of Human Resources shall serve as support staff to the panel.

(E) The service is open to applicants from all agencies except employees of the Governor's Office who are exempt from the State Employee Grievance Procedure Act pursuant to Section 8-17-370(2) and employees of institutions of higher learning. However, two years after the date persons are first appointed to the service, individual institutions of higher learning may apply to the board to allow their employees to participate in the service."

SECTION 2. This act takes effect upon approval by the Governor.
