A BILL

TO AMEND SECTION 61-4-50, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE UNLAWFUL SALE OF BEER OR WINE TO A MINOR SO AS TO PROVIDE THAT IN ADDITION TO EXISTING PENALTIES THAT A PERSON WHO IS CONVICTED OF VIOLATING THIS SECTION FOR A THIRD OR SUBSEQUENT OFFENSE SHALL HAVE HIS DRIVERS LICENSE SUSPENDED FOR THIRTY DAYS AND NO PART OF THE MANDATORY SUSPENSION SHALL BE SUSPENDED BY THE COURT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 61-4-50 of the 1976 Code is amended by adding a new paragraph at the end of (A) to read:

"(C) In addition to the penalties imposed in (A), for a third or subsequent offense, the Department of Public Safety shall suspend the drivers license of any person who is convicted or who receives a sentence upon a plea of nolo contendere for a period of thirty days. No part of the mandatory drivers license suspension shall be suspended by the court."

SECTION 2. This act takes effect upon approval by the Governor.
