TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 8-11-150 SO AS TO GRANT UP TO THREE DAYS OF PAID LEAVE FOR STATE FULL-TIME PERMANENT OR PROBATIONARY EMPLOYEES ON THE DEATH OF A MEMBER OF THE EMPLOYEE'S IMMEDIATE FAMILY, AND TO DEFINE IMMEDIATE FAMILY TO INCLUDE THE SPOUSE, GREAT GRANDPARENTS, GRANDPARENTS, PARENTS, AUNTS, UNCLES, BROTHERS, SISTERS, CHILDREN, GRANDCHILDREN, AND GREAT GRANDCHILDREN OF THE EMPLOYEE OR THE SPOUSE; AND TO AMEND SECTION 8-11-40, AS AMENDED, RELATING TO STATE EMPLOYEE SICK LEAVE SO AS TO INCLUDE AUNTS AND UNCLES IN THE DEFINITION OF IMMEDIATE FAMILY FOR PURPOSES OF USING SICK LEAVE TO CARE FOR ILL FAMILY MEMBERS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 11 of Title 8 of the 1976 Code is amended by adding:
"Section 8-11-150. (A) A full-time permanent or probationary state employee, upon request, is granted up to three consecutive workdays of leave with pay on the death of a member of the employee's immediate family. The employee requesting leave shall submit a statement to the employer stating the name of the deceased, the employee's relationship to the deceased, and the number of days of leave requested.
(B) For purposes of this section, 'immediate family' means the spouse, great grandparents, grandparents, parents, aunts, uncles, brothers, sisters, children, grandchildren, and great grandchildren of either the employee or the spouse."
SECTION 2. The last paragraph of Section 8-11-40 of the 1976 Code, as last amended by Part II, Section 65 of Act 171 of 1991, is further amended to read:
"Employees earning sick leave as provided in this section may use not more than eight days of sick leave annually to care for ill members of their immediate families. For purposes of this section, 'immediate family' means a spouse, children, mother, father, a spouse's mother and father, legal guardian, spouse's legal guardian, an aunt, uncle, and grandchildren if the grandchild resides with the employee, and the employee is the primary caretaker of the grandchild."
SECTION 3. This act takes effect upon approval by the Governor.
