A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 12-21-2435 AND TO AMEND SECTION 52-7-20, AS AMENDED, RELATING TO THE STATE ATHLETIC COMMISSION, BOTH SO AS TO PROVIDE FOR ANNUAL COMPENSATION OF THE COMMISSION MEMBERS AND TO PROVIDE FOR FUNDING OF THE COMPENSATION BY IMPOSITION OF A SURCHARGE ON ADMISSION TO CERTAIN EVENTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Article 17, Chapter 21, Title 12 of the 1976 Code is amended by adding:

"Section 12-21-2435. (A) In addition to the license tax imposed pursuant to Section 12-21-2420 and any other applicable tax, there is imposed a surcharge equal to fifty cents on each paid admission to an event regulated by the State Athletic Commission, as specified in Section 52-7-30.

(B) The revenue of the surcharge imposed by this section must be allocated as follows:

(1) forty-two thousand dollars of the first one-hundred thousand dollars to pay annual compensation for the seven members of the commission;

(2) fifty-eight thousand dollars of revenue after that designation for compensation in subsection (B)(1) to general operations of the commission; and

(3) any amount of revenue raised in excess of one hundred thousand dollars to the general fund."

SECTION 2. Section 52-7-20 of the 1976 Code, as last amended by Act 381 of 1994, is further amended to read:

"Section 52-7-20. (A) The commission shall meet at least twice yearly at the call of the chairman. The chairman may call other meetings when considered necessary and must do so on the direction of the majority of the commissioners. The members are allowed the usual per diem, mileage, and subsistence as provided by law for members of boards, committees, and commissions. The administrator shall administer the affairs of the commission under policies established by the commission. Decisions of the administrator may be appealed to the full commission. Any decision of the full commission to suspend, revoke, or deny a permit or license may be appealed to an administrative law judge as provided under Article 5 of Chapter 23 of Title 1.

(B) In addition to the usual per diem as provided by law, the commission members shall receive compensation in the amount of six thousand dollars a year.

(C) The compensation of the commission members as provided in subsection (B) must be funded through the imposition of a fifty-cent surcharge on admission to the events regulated by the commission, as specified in Section 52-7-30. The first forty-two thousand dollars in revenue raised from the surcharge must fund the compensation, the next fifty-eight thousand dollars in revenue from the surcharge must be used for operating expenses of the commission, and any amount of revenue raised in excess of one hundred thousand dollars must go to the general fund."

SECTION 3. This act takes effect upon approval by the Governor.
