TO AMEND SECTION 12-28-2740, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DISTRIBUTION OF "C" FUNDS DERIVED FROM THE TWO AND SIXTY-SIX ONE-HUNDREDTHS CENTS A GALLON GASOLINE TAX, SO AS TO REQUIRE ONE-THIRD OF THESE FUNDS BE DISTRIBUTED BASED ON THE LAND AREA OF THE STATE AS DEFINED BY THE UNITED STATES CENSUS BUREAU FOR PURPOSES OF THE LATEST DECENNIAL CENSUS AND TO PROVIDE THAT ONE-THIRD OF THESE FUNDS BE DISTRIBUTED BASED ON THE LATEST OFFICIAL DECENNIAL CENSUS UNLESS THE REVISED CENSUS POPULATION FIGURES REFLECT THE MOST CURRENT POPULATION FIGURES FOR THE STATE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 12-28-2740(A)(1) and (2) of the 1976 are amended to read:
"(1) one-third distributed in the ratio which the land area of the county bears to the total land area of the State, which shall be calculated based on the definition of land area adopted by United States Census Bureau for purposes of the latest decennial census;
(2) one-third distributed in the ratio which the population of the county bears to the total population of the State as shown by the latest official decennial census, but the latest revised census population figures certified by the Office of Research and Statistics of the Budget and Control Board must be used for this calculation, if the revised population figures reflect the most current certified population figures for the State;"
SECTION 2. This act takes effect upon approval by the Governor.
