TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-63-75 SO AS TO PERMIT THE STATE BOARD OF EDUCATION TO GRANT A WAIVER TO PERMIT A STUDENT WHO SUFFERS FROM A MEDICAL CONDITION AND WHO WOULD BENEFIT BY ATTENDING ANOTHER SCHOOL TO ATTEND A SCHOOL OTHER THAN THE ONE HE ATTENDS OR WOULD BE ASSIGNED UNDER CERTAIN CONDITIONS, AND TO PROVIDE PROCEDURES TO IMPLEMENT THIS PROVISION INCLUDING REIMBURSEMENTS BY HIS RESIDENT SCHOOL DISTRICT FOR THE COST OF ATTENDANCE AT A SCHOOL IN ANOTHER SCHOOL DISTRICT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 59-63-75. The State Board of Education may grant a waiver of attendance zone and other requirements so that a student may attend another school, within or without his district of residence, if the student suffers from a medical condition which necessitates his attendance at a school other than the one he attends or would be assigned. The parent or legal guardian of the student must apply to the State Board of Education for the waiver. The application must specify the school the student desires to attend and include certification of the condition justifying the student's attendance at another school by two licensed medical doctors and a psychologist. In granting the waiver, the state board shall stipulate which other school the student shall attend. The assigned school may be but does not have to be the school requested by the student, and the school district wherein that school is located must accept the student regardless of any other requirements provided by law. If the school is not in the student's district of residence, his resident school district shall reimburse the district containing the school the student shall attend for his costs of attendance determined as provided in Section 59-63-45. This reimbursement may be waived by the district containing the school the child shall attend. Transportation to the assigned school shall be the responsibility of the parent or guardian."
SECTION 2. This act takes effect upon approval by the Governor.
