A BILL

TO AMEND SECTION 5-15-90, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MUNICIPAL ELECTIONS CONDUCTED BY MUNICIPAL ELECTION COMMISSIONS, SO AS TO PROVIDE THAT THE CHAIRMAN OF EACH COMMISSION MUST BE TRAINED AND CERTIFIED BY THE STATE ELECTION COMMISSION, AND TO FURTHER PROVIDE THAT THE OTHER COMMISSIONERS AND THEIR STAFFS MAY ALSO BE TRAINED AND CERTIFIED IF REQUIRED BY THE MUNICIPAL GOVERNING BODY.

Amend Title To Conform

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 5-15-90 of the 1976 Code is amended to read:

"Section 5-15-90. All municipal elections held under the provisions of this chapter shall be conducted by a municipal election commission composed of three electors who shall be residents of the municipality and who shall be appointed by the municipal governing body. The terms of the members shall be six years except of those first appointed one shall serve a term of four years and one a term of two years. At their first meeting, the commission must organize and elect a chairman. The chairman must, within twelve months of his appointment or reappointment, complete a training and certification program conducted by the State Election Commission. Other commission members and staff, if applicable, may take this program if required by the governing body."

SECTION 2. This act takes effect upon approval by the Governor.
