THE COMMITTEE ON JUDICIARY

To whom was referred a Bill (S. 1198), to amend the Code of Laws of South Carolina, 1976, by adding Section 23-3-415 so as to require the State Law Enforcement Division to be responsible for funding each county sheriff's site preparation, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, beginning on line 22, by striking SECTION 1 in its entirety and inserting therein the following:

/ SECTION 1. The 1976 Code is amended by adding:

"Section 23-3-415. The State Law Enforcement Division is responsible for funding each county sheriff's site preparation costs as part of a statewide computerized sex offender registry network developed by the division. Each sheriff must use the funding for the installation of a backdrop and lights, configuration of a room to accommodate a computer and camera, and storage." /

Renumber sections to conform.

Amend title to conform.

STATEMENT OF ESTIMATED FISCAL IMPACT

ESTIMATED FISCAL IMPACT ON GENERAL FUND EXPENDITURES:

ESTIMATED FISCAL IMPACT ON FEDERAL & OTHER FUND EXPENDITURES:

$0 (No additional expenditures or savings are expected)

EXPLANATION OF IMPACT:

SLED projects that it will cost approximately $2,100 to annually maintain each of the forty-six sites representing a total recurring cost of $96,600. This will cover the annual contract to maintain the personal computer, camera and software. Further, there is a one-time non-recurring cost of approximately $3,500 for each site, a total of $161,000, for the installation of backdrop, lights, and the configuration of a room to accommodate the computer, camera and storage.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-3-415 SO AS TO REQUIRE THE STATE LAW ENFORCEMENT DIVISION TO BE RESPONSIBLE FOR FUNDING EACH COUNTY SHERIFF'S SITE PREPARATION AND MAINTENANCE COSTS AS PART OF A STATEWIDE COMPUTERIZED SEX OFFENDER REGISTRY NETWORK.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 23-3-415. The State Law Enforcement Division is responsible for funding each county sheriff's site preparation and maintenance costs as part of a statewide computerized sex offender registry network developed and maintained by the division. The site preparation and maintenance costs must be used by each sheriff for the installation of a backdrop and lights, configuration of a room to accommodate a computer and camera, storage and the annual maintenance costs associated with the computer, camera, and software."

SECTION 2. This act takes effect upon approval by the Governor.
