To whom was referred a Bill (H. 3062), to amend Chapter 11 of Title 34, Code of Laws of South Carolina, 1976, relating to bank deposits, etc., respectfully
That they have duly and carefully considered the same, and recommend that the same do pass with amendment:
Amend the bill, as and if amended, by striking Section 34-11-140 as contained in SECTION 1 and inserting:
/"Section 34-11-140. A state agency must attempt to collect a dishonored check returned to the agency as provided by Section 34-11-70 or Section 34-11-75. Collected revenues equal to the face amount of the dishonored check and the twenty-five dollar service charge may be retained and expended by the agency and any unused amount must be deposited in the general fund at the end of the fiscal year." /
Amend title to conform.

Section 72.66 of the 1998-99 Appropriation Act authorizes state agencies to collect and retain a fine to cover the cost of collecting a dishonored check, therefore, there will be no additional cost to the General Fund of the State. Further, the General Appropriation Bill as recommended by the Governor for 1999-2000 includes the section without any changes.

TO AMEND CHAPTER 11 OF TITLE 34, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO BANK DEPOSITS, BY ADDING SECTION 34-11-140 SO AS TO AUTHORIZE A STATE AGENCY TO ESTABLISH, COLLECT, AND RETAIN A FINE TO COVER THE COST OF COLLECTING A DISHONORED CHECK.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 11 of Title 34 of the 1976 Code is amended by adding:
"Section 34-11-140. A state agency may establish, collect, and retain a fine to cover the cost associated with the collection of a dishonored check returned to the agency due to insufficient funds. This fine must be retained and expended by the agency solely for that purpose and an unused amount must be carried forward to the following fiscal year."
SECTION 2. This act takes effect upon approval by the Governor.
