A BILL

TO AMEND SECTION 40-47-160, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO RECIPROCAL CERTIFICATION OF PHYSICIANS BY THE STATE BOARD OF MEDICAL EXAMINERS, SO AS TO ALLOW RECIPROCAL CERTIFICATION OF PHYSICIANS LICENSED BY THE MEDICAL COUNCIL OF CANADA.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 40-47-160 of the 1976 Code is amended to read:

"Section 40-47-160. (1)(A) The board may grant or refuse certifications to licentiates of the National Board of Medical Examiners, the Medical Council of Canada, or of the National Board of Examiners for Osteopathic Physicians and Surgeons without further examination and may make and establish all necessary rules and regulations for the reciprocal recognition of certificates issued by other state boards having an equal standing. This section shall applies only apply to doctors of osteopathy who graduated after January 1, 1955, from a school approved by the American Osteopathic Association and who now hold unlimited license. Graduates before January 1, 1955, may make application and appear before the Board of Medical Examiners for interview, with each applicant to be considered for approval on the basis of his training and experience.

(2)(B) The State Board of Medical Examiners shall may not grant reciprocity or issue a limited or temporary or permanent license to a licensed physician or an intern of another state of the United States who applies for licensure after May 31, 1985, and:

(1) whose license is currently restricted in any way or who is currently on a probationary status in that state.; or

(2) The State Board of Medical Examiners shall not grant reciprocity or issue a limited or temporary or permanent license to a licensed physician or an intern of another state of the United States who currently has disciplinary action pending against him in that state. The provisions of subsection (2) of this section shall not apply to any physician or surgeon who has made application for licensure prior to June 1, 1985."

SECTION 2. This act takes effect upon approval by the Governor.
