A JOINT RESOLUTION

TO APPROVE REGULATIONS OF THE BUDGET AND CONTROL BOARD, RELATING TO COMMERCIAL MOBILE RADIO SYSTEM SURCHARGE, DESIGNATED AS REGULATION DOCUMENT NUMBER 2376, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The regulations of the Budget and Control Board, relating to commercial mobile radio system surcharge, designated as Regulation Document Number 2376, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION 2. This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED

BY PROMULGATING AGENCY.

The regulation amends Regulation Chapter 19 Article 2 Information Resource Management by adding Regulation 19-204 to establish the monthly CMRS (cellular, PCS, wireless telecommunications) surcharge, as the average of all telephone E911 surcharges collected in one or more months in the preceding year as calculated by the statutory CMRS Emergency Telephone Services Advisory Committee, and to authorize the state's CMRS providers to collect the surcharge for the State from all of their subscribers in South Carolina. The 1998 Act R441 authorized the surcharge to support E911 services, especially enhanced CMRS E911 services, and will be distributed primarily to the County 911 Public Safety Answering Points and CMRS companies to reimburse them for their costs of complying with the Federal Communications Commission Automatic Number Identification (ANI) (Phase 1) and Automatic Location Identification (ALI) (Phase 2), enhanced CMRS 911 requirements.
