A JOINT RESOLUTION

TO APPROVE REGULATIONS OF THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL, RELATING TO ENVIRONMENTAL PROTECTION FEES, DESIGNATED AS REGULATION DOCUMENT NUMBER 2374, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The regulations of the Department of Health and Environmental Control, relating to environmental protection fees, designated as Regulation Document Number 2374, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.

SECTION 2. This joint resolution takes effect upon approval by the Governor.

SUMMARY AS SUBMITTED

BY PROMULGATING AGENCY.

The department is amending Regulation 61-30, Environmental Protection Fees, as follows:

(1) Existing fees charged to Public Water Systems will be reduced to more accurately reflect changes in monitoring requirements and financial need to adequately support the Safe Drinking Water Act Regulatory Program. This amendment will incorporate recommendations made by the Safe Drinking Water Act Advisory Board.

(2) A fee will be established for the Individual Residential Well and Irrigation Well Program, which provides for establishing a permitting fee, a procedure for proposed well construction review, compliance inspections, technical assistance, enforcement; and for providing bacteriological analytical services for new individual residential wells. This fee amendment is contingent upon approval of State Register Document No. 2351, proposed new Regulation 61-44, Individual Residential Wells and Irrigation Wells, that was submitted to the South Carolina General Assembly for 1999 legislative review.
