TO ESTABLISH ELECTION DISTRICTS FROM WHICH CERTAIN MEMBERS OF THE BOARD OF TRUSTEES OF ROCK HILL SCHOOL DISTRICT NO. 3 OF YORK COUNTY MUST RESIDE, PROVIDE THAT ALL SEVEN MEMBERS OF THE BOARD MUST BE ELECTED AT LARGE FROM THE DISTRICT, PROVIDE A SCHEDULE FOR ELECTION OF TRUSTEES, THE METHOD OF DETERMINING CANDIDATES ELECTED, AND PROVIDE FOR FILING VACANCIES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. (A) Notwithstanding any other provision of law, beginning with the elections conducted in 2000, the election districts for the members of the Board of Trustees of Rock Hill School District No. 3 of York County are established as follows:

(B)(1) The Board of Trustees of Rock Hill School District No. 3 of York County is composed of seven members elected in a nonpartisan election by the qualified electors of the district with five members required to reside in the five districts delineated in subsection (A) of this section and two elected at large from the district without regard to residency;
(2) The trustees representing districts 1, 3, and 5 and one at-large seat must be elected at the time of the General Election of 2000, and the trustees representing districts 2 and 4 and one at-large seat must be elected at the time of the General Election of 2002. Trustees serving on the effective date of this act elected from residency districts 2 and 4 and the at-large seat shall continue to serve until the expiration of their terms in 2002. Thereafter, all terms of office are for four years, until their successors are elected and qualify.
(3) Each candidate for election shall notify the incumbent board and appropriate election officials in writing of his candidacy by twelve noon on September first. However, if the last day for filing falls on a Saturday, Sunday, or legal holiday, the time period for filing is extended until twelve noon of the next succeeding day which is not a Saturday, Sunday, or legal holiday. The balloting must take place at the general election precincts located within the district and must be conducted according to the laws governing elections in this State, mutatis mutantis. In each election those several candidates receiving the most votes are the duly elected trustees and no runoff is required. All newly elected members of the board shall take office ten days after the election.
(4) If a seat becomes vacant before the expiration of the incumbent's term of office due to death, resignation, removal, or any other cause, the resulting vacancy must be filled by the board of trustees for the unexpired portion of the term until the next election for trustees is held.
SECTION 2. The boundaries of School District No. 3 in York County are not altered by the provisions of this act. These school district lines are as defined by law and any census blocks which may be divided are done so only for statistical purposes and to establish a population base.
SECTION 3. This act takes effect upon approval by the Governor.
