A JOINT RESOLUTION

TO CREATE A COMMITTEE TO STUDY THE LAWS RELATING TO THE PURCHASE AND SALE OF HUNTING AND FISHING LICENSES BY THE DEPARTMENT OF NATURAL RESOURCES, AND THE FEASIBILITY OF THE DEPARTMENT OF NATURAL RESOURCES PROVIDING FOR THE SALE AND ISSUANCE OF HUNTING AND FISHING LICENSES, AND COMBINATIONS OF HUNTING AND FISHING LICENSES, AT A DISCOUNT VIA THE INTERNET AND AT ELECTRONIC POINTS OF SALE IN RETAIL ESTABLISHMENTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    This resolution may be cited as the "South Carolina Sportsmen's License Reform Initiative".

SECTION 2.    (A)    There is created a Sportsmen's Licensing Reform Committee composed of nine members charged with the duty and responsibility of studying the hunting and fishing licensure laws and procedures of the State, and of other states. The committee shall report to the General Assembly by November 1, 2001, with recommended modifications to the laws, methods, and procedures governing the issuance of noncommercial hunting and fishing licenses, permits, tags, and stamps under Title 50 of the Code of Laws of 1976. The committee shall specifically address the following issues:

        (1)    whether and how to implement a system whereby noncommercial Title 50 licenses, permits, tags, and stamps are issued via point-of-sale devices at private retail outlets and state facilities selling such licenses, permits, tags, and stamps with such devices being integrated into and electronically communicating with a central Department of Natural Resources licensing database and computerized information system;

        (2)    whether and how to implement a system whereby noncommercial Title 50 licenses, permits, tags, and stamps are purchased and issued online via the Internet;

        (3)    whether and how to implement a system whereby any combination of multiple noncommercial Title 50 licenses, permits, tags, and stamps may be issued with one document produced by a point-of-sale device or issued online via the Internet, representing the combination of licenses, permits, tags, and stamps purchased;

        (4)    whether and how to expand or modify the Department of Natural Resources database and computerized information system to accommodate the recommendations of the committee;

        (5)    whether noncommercial Title 50 licenses, permits, tags, and stamps should be valid for a period of one year from the date of purchase, rather than for the fiscal year as under current law; and

        (6)    any other changes, additions, modifications or recommendations to the laws, methods, and procedures governing the issuance of noncommercial hunting and fishing licenses, permits, tags, and stamps under Title 50 that the committee deems appropriate.

    (B)    One member of the committee must be appointed by the Governor from the State at large. The member appointed by the Governor is the Chairman of the committee.

    Two members of the committee must be appointed by the Chairman of the Fish, Game, and Forestry Committee of the South Carolina Senate. Of the two members appointed by the Chairman of the Fish, Game, and Forestry Committee of the Senate, one must be the owner or operator of a retail hunting, fishing, and related sporting goods establishment that sells hunting and fishing licenses to members of the public, and one must be a member of a statewide or national hunting or fishing organization.

    Two members of the committee must be appointed by the Chairman of the Agriculture, Natural Resources and Environmental Affairs Committee of the South Carolina House of Representatives. Of the two members appointed by the Chairman of Agriculture, Natural Resources, and Environmental Affairs Committee of the House, one must be the owner or operator of a retail hunting, fishing, and related sporting goods establishment that sells hunting and fishing licenses to members of the public, and one must be a member of a statewide or national hunting or fishing organization.

    Two members of the committee must be appointed by the Chairman of the Board of the Department of Natural Resources from the State at large. Of these two members one may be a member of the department's governing board but, except for board membership, neither of these two appointees may be officers or employees of the state or political subdivision of the State.

    Two members of the committee must be appointed by the Director of the Department of Natural Resources from among the full-time employees of the Department of Natural Resources.

    Terms of committee members expire upon a change in the member's status that would have rendered the member ineligible for appointment to the committee at the time of his appointment, or upon dissolution of the committee. Vacancies to the committee must be filled in the same manner as the original appointment. All members of the committee must be residents of South Carolina and shall serve until their successors are appointed.

    The members are allowed mileage, per diem, and subsistence at the rates provided by law for members of boards, committees, and commissions and must be paid from funds appropriated to the Department of Natural Resources for mileage, per diem, and subsistence.

    (C)    The committee or any subcommittee thereof appointed by the chairman, may hold hearings, sit, and act at times and places within the State as the chairman designates.

    (D)    The Department of Natural Resources must provide necessary staff, secretarial support, legal counsel, and material support from personnel employed by the department and supplies on hand without additional compensation or expense.

SECTION    3.    This joint resolution takes effect upon approval by the Governor.
