A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-47-115 SO AS TO PROHIBIT A PROGRAM TO BE ADMINISTERED BY THE SCHOOL FOR THE DEAF AND THE BLIND OR CONDUCTED ON THE PROPERTY OF THE SCHOOL FOR STUDENTS WITH PSYCHOLOGICAL OR BEHAVIORAL PROBLEMS TO THE EXTENT THAT THESE STUDENTS MAY HARM OR PRESENT A THREAT OF HARM TO THE DEAF, HARD OF HEARING, BLIND, OR VISUALLY IMPAIRED STUDENTS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The 1976 Code is amended by adding:

    "Section 59-47-115.    Notwithstanding any other provision of law, no program may be administered by the School for the Deaf and the Blind or conducted on property under the jurisdiction of the school for students who have psychological problems to the extent that these students may harm or endanger or present a threat of harm or danger to the deaf, hard of hearing, blind, or visually impaired students."

SECTION    2.    This act takes effect upon approval by the Governor.
