A BILL

TO AMEND SECTION 40-56-10, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE STATE BOARD OF PYROTECHNIC SAFETY, SO AS TO REVISE THE MEMBERSHIP OF THE BOARD AND PROVIDE THAT THE BOARD SHALL OPERATE UNDER THE DIVISION OF FIRE AND LIFE SAFETY OF THE DEPARTMENT OF LABOR, LICENSING AND REGULATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 40-56-10, as last amended by Act 181 of 1993, is further amended to read:

    "Section 40-56-10.    There is created the State Board of Pyrotechnic Safety to be composed of six members appointed by the Governor. One of the appointees must be a fireman, one must be a pyrotechnics retailer, one must be a law enforcement representative, and three must be members of the public who shall not possess any pecuniary interest in any entity engaged in a business directly involving the sale of pyrotechnics which shall operate under the Division of Fire and Life Safety of the Department of Labor, Licensing and Regulation. The board shall be composed of seven members appointed by the Governor. Three of the members shall be firefighters, one member shall be a pyrotechnics retailer, one shall be a member of the public who shall not possess any pecuniary interest in any entity engaged in a business directly involving the sale of pyrotechnics, and one member shall be from the South Carolina Forestry Commission with expertise in wildfire management and control. The State Fire Marshal shall be the seventh member of the board to serve ex officio and as chairman. The board shall elect from its members a chairman, vice-chairman vice chairman, and such other officers as it may consider necessary to serve for terms of one year and until their successors are elected and qualify. Except for the ex officio member, terms of office for members are for two years and until their successors are appointed and qualify. Vacancies must be filled in the manner of original appointment for the unexpired term. The board shall meet at least annually and not more than once per each month. All meetings must be scheduled at the call of the chairman. All members shall receive mileage, per diem, and subsistence as provided by law for members of boards, committees, and commissions for days on which they are transacting official business, to be paid from the general fund of the State. The Director of the Department of Labor, Licensing, and Regulation, pursuant to Section 40-73-15, shall employ such personnel as necessary to carry out the duties of the board."

SECTION    2.    The terms of the present members of the State Board of Pyrotechnic Safety shall expire on July 1, 2001, at which time the new members of the board appointed in the manner required by Section 40-56-10 of the 1976 Code, as amended by this act shall take office.

SECTION    3.    This act takes effect upon approval by the Governor.
