A JOINT RESOLUTION

TO REQUIRE THE SOUTH CAROLINA COMMISSION ON HIGHER EDUCATION TO REINSTATE THE RENEWAL OF THE PALMETTO FELLOWS SCHOLARSHIP FOR ANY STUDENT WHO SUCCESSFULLY COMPLETED THE MANDATORY MINIMUM OF THIRTY CREDIT HOURS FOR THE ACADEMIC YEAR 1999-2000, INCLUDING EXEMPTED CREDIT HOURS, AS LONG AS THE STUDENT APPEALED THE DISQUALIFYING DECISION OF THE COMMISSION, AND AS LONG AS THE STUDENT MET AND CONTINUES TO MEET ALL OTHER CRITERIA.

Whereas, the General Assembly established the Palmetto Fellows Scholarship, as set forth in Section 59-104-20, to foster scholarship among the State's postsecondary students and to retain outstanding South Carolina high school graduates in the State through awards based on scholarship and achievement;

Whereas, the purpose of the Palmetto Fellows Scholarship Program is to recognize the most academically talented high school seniors in South Carolina and to encourage them to attend eligible colleges or universities in this State;

Whereas, each Palmetto Fellow must maintain a certain grade point average and must complete a minimum number of credit hours for each academic year to meet the standards of the Palmetto Fellows Scholarship program in order to renew the scholarship for the next academic year;

Whereas, during 1999-2000, some Palmetto Fellows who had completed more than the required number of credit hours were subsequently found disqualified by the South Carolina Commission on Higher Education because of an ambiguity in the stated requirements of the renewal qualifications, specifically, the application of exempted credit hours. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The South Carolina Commission on Higher Education is required to reinstate the renewal of a Palmetto Fellows Scholarship for any student who appealed the disqualifying decision of the Commission, if the sole reason for denial of the scholarship was that, although the student earned the requisite thirty total credit hours by the end of academic year 1999-2000, included in the student's thirty-hour total were exempted credit hours.

SECTION 2. This joint resolution takes effect upon approval by the Governor.
