TO AMEND ARTICLE 7, CHAPTER 23, TITLE 16, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO BOMBS, DESTRUCTIVE DEVICES, AND WEAPONS OF MASS DESTRUCTION, BY ADDING SECTION 16-23-780 SO AS TO PROVIDE FOR ALTERNATIVE MAXIMUM IMPRISONMENT FOR CERTAIN OFFENSES COMMITTED TO FACILITATE A DRUG TRAFFICKING CRIME OR AN ACT OF INTERNATIONAL TERRORISM.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 7, Chapter 23, Title 16 of the 1976 Code is amended by adding:
"Section 16-23-780. (A) For purposes of this section:
(1) 'Additional imprisonment' means imprisonment for a specified number of years, for any number of years, or for life imprisonment, including life imprisonment without parole, in addition to the maximum period of imprisonment that may be imposed for a specific offense under this article.
(2) 'International terrorism' means 'international terrorism' as defined in 18 U.S. Code, Section 2331.
(B) Notwithstanding any other provision of this article, the maximum term of additional imprisonment that may be imposed for an offense under this article:
(1) if committed incident to or to facilitate a drug trafficking crime is fifteen years in addition to the maximum imprisonment that may be imposed for the specific offense under this article; and
(2) if committed incident to or to facilitate an act of international terrorism is imprisonment for any number of years, or life imprisonment without parole, in addition to the maximum imprisonment that may be imposed for the specific offense under this article."
SECTION 2. This act takes effect upon approval by the Governor.
